Apple Specifically Prohibits Jailbreaking, iPhone OS 3.0 Jailbreak Already Confirmed
Apple has recently released the first Beta version of their 3.0 version of the iPhone OS, and has even made iPhone OS 3.0 Beta 2 available to developers. With the release of iPhone OS 3.0 Beta to it came to light that Apple does not officially allow developers to explore the operating system’s MMS and tethering capabilities; the iPhone Developer Program License Agreement now brings some additional bad news for iPhone developers, mainly the fact that Apple does not take kindly to them jailbreaking or aiding others in jailbreaking the device.
“You will not, through use of the Apple Software, services or otherwise, create any Application or other program that would disable, hack or otherwise interfere with the Security Solution, or any security, digital signing, digital rights management, verification or authentication mechanisms implemented in or by the iPhone operating system software, iPod touch operating system software, this Apple Software, any services or other Apple software or technology, or enable others to do so. Applications developed using the Apple Software may only be distributed if selected by Apple (in its sole discretion) for distribution via the App Store or for limited distribution on Registered Devices (ad hoc distribution) as contemplated in this Agreement,” says the Developer Program License Agreement as reported by Ars Technica.
The fact that Apple does not want developers or users jailbreaking the device is not exactly news. The Cupertino-based company made that especially clear when it filled a document with the Copyright Office as part of the 2009 DMCA triennial rulemaking (read the whole PDF here) in which it deemed jailbreaking the iPhone and iPod touch a DMCA (Digital Millennium Copyright Act) violation and copyright infringement. The EFF (Electronic Frontier Foundation) and Mozilla promptly spoke against Apple and its decision (details here), but it seems that it had little influence on the matter.
In related iPhone OS 3.0 news – and in an ironical twist of fate – it seems that a Russian hacker going by the name of Vortex has already been successful in jailbreaking the iPhone OS 3.0. the iPhone Dev Team, who spoke against users updating to OS 3.0 is they still want to use YellowSn0w (details here), have come out to acknowledge the jailbreak.
“Well, the cat is out of the bag. The 3.0 firmware from Apple can be jailbroken, and there are now sites out there giving you that jailbreak (after you sort through various ads and browser popups, etc). Of course it’s not really a surprise that it can be jailbroken. One of the nicest things about the jailbreaking iPhones and iPod Touches nowadays is that once a given device can be jailbroken, it can always be jailbroken. The exploits we’re forced to resort to are down at the hardware level, where nothing can be done about them via software. THE MOST IMPORTANT THING ABOUT THE UNOFFICIAL QUICKPWN RELEASES IS THAT IF YOU USE THEM, YOU WILL KILL YELLOWSN0W, POSSIBLY FOREVER."
